OVERVIEW

Welcome to Shuck Yeah! By engaging our services, you agree to the terms and conditions outlined below. These Terms of Service govern the relationship between you, the Client, and Shuck Yeah, a business operated by 3 Fish Co Pty Ltd. Please read these terms carefully.

DEFINITIONS

“Services”: Refers to our catering and event services, including but not limited to, the provision of food and staff.
“The Equipment”: Includes all goods, The Oyster Bar Cart, The Full Oyster Bar, all other equipment, consumables, and accessories provided by Shuck Yeah for your event.
“The Client”: Refers to you, the person, or your authorized representative who is engaging our services for your event.
“The Site”: The location where the event takes place and/or where the equipment is used.
“Our” and “We”: Refers to Shuck Yeah, its employees, and contractors.

MODIFICATIONS TO THE SERVICE AND PRICES

Shuck Yeah reserves the right to modify or discontinue any of our services or adjust prices at any time without prior notice.

PERSONAL INFORMATION

Your submission of personal information through our website and during the booking process is governed by our Privacy Policy.

PAYMENT

  • A 50% deposit is required at time of booking to secure your event date.

  • The remaining balance must be paid 7 days prior to the agreed event date.

  • All prices listed on our website or quotations are exclusive of GST.

  • A minimum spend of $460.00 plus GST is required for all catered events.

FUNCTIONS, FOOD, AND PERSONNEL

The Client must confirm their package option and add-ons at the time of booking. Any changes must be made in writing no later than 14 days before the event.

If we are required to work beyond the estimated times agreed upon at time of booking, additional charges will apply per hour, per staff member, or part thereof. These additional hours will be invoiced after the event at a rate of $25 per 30 minutes.

FOOD ALLERGIES

As caterers of mollusc and shellfish products, it is the Clients responsibility to inform guests that food containing molluscs and/or shellfish will be present. Shuck Yeah is not liable for any injuries caused by mollusc and/or shellfish allergies.

CANCELLATION

  • Cancellations must be made in writing by sending an email to hannah@shuckyeah.com.au

  • Cancellations made more than 30 days prior to the event date will receive a full refund of the deposit.

  • Cancellations made between 30 and 14 days prior to the event date will result in a forfeiture of 50% of the deposit.

  • Cancellations made between 13 and 7 days prior to the event date will result in a forfeiture of 100% of the deposit

  • Cancellations made within 6 days of the event date will result in a forfeiture of the total invoice amount.

FEEDBACK

If you have any concerns during your event, please speak to a member of our staff immediately. We will work to resolve any issues quickly and effectively. Your feedback is important to us, and we encourage you to contact us with any comments or questions.

MEDIA

Shuck Yeah may feature media collected from your event on our social media channels and website. This may include images, testimonials, and videos.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

Shuck Yeah provides services “as is” and “as available” without any warranties of any kind. We do not guarantee that our services will meet your expectations or be error-free. In no event shall Shuck Yeah be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our services.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Shuck Yeah and its affiliates from any claims, liabilities, damages, and expenses arising out of your use of our services.

GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of Australia.
